Shane Capps

Shane assists clients in the design and implementation of strategies to identify, protect, defend, enforce, and build value around intellectual property assets. Through his extensive experience with the preparation and prosecution of both patent and trademark applications, he is able to help clients develop robust intellectual property portfolios. He also has experience in counseling clients dealing with competitor and third-party patents by evaluating these patents and providing opinions of non-infringement and invalidity. Shane routinely conducts portfolio analyses, landscape analyses, and due diligence to advise clients of risks and opportunities related to intellectual property

Shane has experience counseling a broad clientele base that includes small start-ups and global Fortune 500 companies alike. He has technical expertise in, among other fields, medical devices (including orthopedic devices, catheters, stents, and drug delivery systems), consumer products (including luggage, hygiene products, and children’s toys), outdoor products (including bicycles, footwear, and clothing), consumer electronics (including wearable devices, handheld devices, and laptops), packaging/shipping technologies, natural resource technology (including mining systems and processes), and green technology (including vehicle emissions reduction systems and fuel efficiency systems).

As a former research and development engineer, Shane uses his experience working in industry to provide client counseling and strategy development from a business-centric perspective by understanding the competing internal demands faced by clients. This background, coupled with more than a decade of legal experience, allows him to effectively address clients’ intellectual property needs.
