David A. Hearne

David has significant experience in the areas of construction law, litigation, government contracts, bid protests, surety law, and commercial leasing, having previously worked with the firm of Outland, Gray, O’Keefe & Hubbard for 30 years.  David has extensive trial experience in jury and nonjury cases before state and federal courts in Virginia, and he has frequently appeared before the U.S. Court of Federal Claims, U.S. Courts of Appeals for the Fourth and Federal Circuits, the Armed Services Board of Contract Appeals (“ASBCA”), other agency boards, and the Government Accountability Office (“GAO”) in addition to numerous mediation and arbitration proceedings.  

During his 30-year career as a construction attorney, David has represented prime contractors, subcontractors, suppliers, owners, landlords, and sureties in construction, government contracts, and commercial leasing matters handling a broad array of disputes and claims.  He recognizes that his job is all about managing and minimizing risk, including protecting his clients based on their construction contract documents.  David believes that early intervention of an experienced construction law professional in any dispute can reduce risk and potential liability.  He encourages his clients to contact him immediately should they experience any event giving rise to an issue of potential liability.  David has boots and a hard hat in his car. 

David is a lifetime resident of Hampton Roads, having attended Hampton High School, Old Dominion University, and William & Mary School of Law.  Married for more than 30 years with 3 grown boys, David is also passionate about soccer, which he has played, coached and refereed for 40 years – and he is a fanatic for Manchester United Football Club.…Glory, Glory.
